01 — Who we are thenewzeroclimbing.com (the "Site") is operated by Cruxworks LLC, a Delaware limited liability company, doing business as The New Zero ("we," "us"). Contact: care@thenewzeroclimbing.com.
02 — Acceptance By accessing the Site or placing an order, you agree to these Terms, our Privacy Policy, and our Shipping & Returns policy. If you do not agree, do not use the Site.
03 — Eligibility You must be at least 18 years of age and legally able to enter into a binding contract. Purchases are for personal, non-commercial use unless we agree otherwise in writing.
04 — Products and intended use Renew and Rescue are cosmetic products intended for external use on intact skin. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease or condition. Content on the Site is provided for general information and does not constitute medical advice. Read the label and the Product Safety page before use. Rescue contains milk protein.
05 — Orders and acceptance Your order constitutes an offer to purchase. Acceptance occurs when we send a shipping confirmation. We may decline or cancel any order prior to acceptance, including for suspected fraud, pricing or listing errors, or limited availability. If an order is cancelled after payment, we will issue a full refund.
06 — Pricing, tax, and payment Prices are stated in US dollars and are subject to change without notice. Applicable sales tax is calculated at checkout. If a listed price is clearly erroneous, we may cancel the order and refund the payment. Payments are processed by Shopify Payments; we do not store payment card numbers.
07 — Promotions Unless otherwise stated, discount codes are limited to one use per customer, may not be combined with other offers, may not be applied to prior purchases, and may be withdrawn at any time. The new-subscriber offer applies to a customer's first order only.
08 — Shipping and returns Shipping, returns, and refunds are governed by our Shipping & Returns policy, which is incorporated into these Terms. Risk of loss passes to you upon our delivery of the package to the carrier.
09 — Notify-me and waitlists Joining a notify-me or waitlist does not reserve product or create an order. Availability dates are estimates.
10 — Intellectual property The Site, its content, the The New Zero name and logo, product names, and packaging are owned by Cruxworks LLC or its licensors and are protected by trademark and copyright law. You may not copy, reproduce, distribute, or use them for commercial purposes without our prior written permission.
11 — Reviews and submissions By submitting a review, photograph, or comment, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use it on the Site and in our marketing, attributed by first name or handle. Submissions must be your own, truthful, and based on actual use of the product. We may remove any submission at our discretion. Any incentive offered in exchange for a review will be disclosed.
12 — Prohibited conduct You may not use the Site for any unlawful purpose, interfere with its operation, extract data by automated means, or attempt to access accounts or systems without authorization.
13 — Disclaimer of warranties The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Individual results vary.
14 — Limitation of liability To the fullest extent permitted by law, Cruxworks LLC shall not be liable for any indirect, incidental, special, or consequential damages. Where liability cannot be excluded, it is limited to the amount paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence.
15 — Governing law and jurisdiction These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute shall be brought in the state or federal courts located in Cook County, Illinois, except where applicable consumer protection law provides otherwise.
